HOW AND WHAT KIND OF INFORMATION WE COLLECT
Personal data is collected with the consent of the User, which he has provided to "Bavacki.bg". "User consent" means any freely given, specific and informed statement by which an individual unambiguously consents to his/her Personal Data being collected and processed. If the User creates an account, this will be deemed to be his/her consent to the processing of his/her Personal Data.
Personal Data is collected for specific and lawful purposes and will not be further processed in any way incompatible with this. They should be relevant, connected to and strictly in accordance with the purposes for which they are processed. The personal data provided must be accurate and up to date at the time it is entered. Personal data shall be erased or rectified if they are incorrect or not relevant to the purposes for which they are processed and shall be kept in a form which permits identification of the natural person concerned for no shorter period than is necessary for the purposes for which they are processed.
Personal data and other information is collected through the Site. Depending on which services you use, we collect different information from or about you. In some cases, we collect information about your family members or relatives to contact in case of an emergency and/or medical personnel/personal physician or other persons related to you in any way. You may provide this additional information in order to receive our best quality Services. Please do not provide any Personal Information to any third party without their prior consent or without a legal basis for providing that Personal Information to us. In the event that we receive Personal Data of a third party, we will take the necessary steps to protect it in accordance with this Privacy Policy.

"Consent of the individual" shall be deemed to be any freely given, specific and informed statement by which the individual to whom the Personal Data relates clearly consents to its processing. Acceptance of the Privacy Policy of "Bavachki.bg" shall be deemed to be consent by the individual.

14. Criminal record, medical certificate issued within the last six months, for babysitters;
15. Price range for babysitters: day labor, night labor, weekdays, weekends, public holidays, daytime, 1,2,3+ children;

The above list of required information may change from time to time depending on the type of Services requested and provided. "Bavachki.bg reserves the right to request any of the above information outside of the Site and prior to registering a user account on the Babysitters Site. The above may vary for parents and babysitters.
Bavachki.bg may periodically be required to identify and verify you in order to protect the interests of other users and Bavachki.bg itself. Given that the Service is provided over the Internet, and for security reasons, you agree to provide Bavachki.bg with a form of identification or other identification that can verify your identity from time to time, and only at Bavachki.bg's discretion.
"Bavachki.bg will not process personal data revealing:
(a) racial or ethnic origin;
b) political, religious or philosophical views, membership of political parties and associations with religious, philosophical, political or trade union aims;
(c) sex life or the human genome.
"Bavachki.bg will process health information regarding nannies, such as general health information provided by all nannies, with their explicit consent. It is understood that each Babysitter who visits the Site and provides health information voluntarily consents to Bavachki.bg processing this type of Personal Data. Nannies are required to provide health information about themselves by obtaining a medical certificate and providing it to Bavachki.bg. Health information regarding nannies is collected in order to provide a health risk assessment for all prospective nannies and to determine actions in the event of a need for emergency health care while babysitting. Babysitters consent to the release of their personal health information to parents and others as provided in this Privacy Policy in the event of an emergency, for the purpose of improving Services, to mutually protect the interest of the child, parent and babysitter during the performance of babysitting duties.
"Bavachki.bg will process health information regarding children, i.e. allergies, emergency contacts, the contact details of the personal doctor or other medical person, etc., with the express consent of their parents or legal guardians, in order to protect the life and health of the data subject or of another person if, due to the physical condition of that person, he or she is unable to consent or there are legal obstacles to doing so. It is understood that a Parent who registers a User Account on the Site to use the Services and provides information regarding their child's health voluntarily consents to Bavachki.bg processing this type of Personal Data and providing it to Nannies appointed by Parents to watch their children, contact persons in the event of an emergency or medical emergency, and other recipients as set forth herein. Parents are under no obligation to provide health information about their child, but in most cases it is in their best interest to keep the babysitters informed of health status and requirements regarding the child. In most cases, having up-to-date and accurate health information ensures that the childminder will be able to take appropriate steps in the event of an emergency.
Through the use of the website, mobile applications and/or other means maintained by Bavachki.bg, we obtain certain information about you that can be summarized in the following categories:
a) Location Information: If you give permission to the Bavachki.bg platform to access the location services when you use the Services, we may receive precise location information, including precise information about your mobile device, when the website/app/platform is used on your mobile device and on the company's server. We may also retrieve information about your approximate location from your IP address.
b) Transaction Information: Bavachki.bg may receive details of transactions related to your use of the Site, including the type of service, date and time the service was provided, amount charged and other transaction-related information. In addition, if someone uses your promotional code, we may tie your name to that person. Transaction information received, processed and stored by Bavachki.bg will not include any credit card details of the User. The latter will be collected, processed and stored by the payment service provider "Paysera".
c) Usage and Preference Information: we collect information about how you, visitors and users use the Bavachki.bg Services, what your preferences are and what settings you use. In some cases, we may collect this data through the use of cookies, pixel tags and/or other similar technologies that create and maintain unique identifiers. d) Device Information: We may receive information about your mobile/desktop device, including hardware model, operating system and version, software and file names and versions, preferred language, unique device identifiers, advertising identifiers, serial number, device movement information, and mobile network information.
e) Account Login Information: During your use of the Services, we collect server log files, which may include information such as device IP address, date and time accessed, application properties or pages viewed, application crashes and other system activity, browser type, and third party site or service you used prior to using the Bavachki.bg Services.
f) Information from other sources: if you choose to link to, create, or log in to your Bavachki.bg account through a social media service, such as Facebook, or if you engage with a separate application or website that uses an API (or whose API we use), we may receive information about you or your links from that site or application. Your provision of data is voluntary and the consequences of refusing to provide the data are reflected in your inability to use the Services to their full capacity or at all. If you do not wish to provide any information, do not register a User Account on the Site.
HOW WE USE THE PERSONAL DATA YOU PROVIDE
Bavachki.bg requires the information set forth above to provide, improve and develop a market platform and venue for people seeking babysitting services to connect with people willing to provide those services, and to work toward your satisfaction with and continuous improvement of the Services offered by the Site. Thus, Bavachki.bg may collect the information for the following purposes:
- Provide, maintain and improve our Services, including, for example, to verify the age of Users, to create and manage your personal profile, to contact you in the event of problems with the Site and the Service, in response to your inquiries and in order to inform you of new or changed services, to send you offers for marketing purposes, for promotional services and the provision of certificates free of charge, for babysitting educational services, first aid course and certification, in order to facilitate payments, to send to
- Perform internal operations, including, for example, to prevent fraud and abuse of our Services; to fix software bugs and operational issues, conduct data analysis, testing and research; and to monitor and analyze usage and activity trends;
- Send and facilitate communication between Parents and Babysitters, such as the estimated total amount of the engagement; date and time of the engagement, specific information about the child/children, etc;
- To send you messages that we find interesting, including information about products, services, promotions, news and events organized by Bavachki.bg;
- Personalise and improve the Services, including to provide or recommend features, content, social links, referrals and advertisements;
- Protect the legal rights of "Bavachki.bg" by disclosing User information to appointed and authorized representatives.
We retain User information for as long as necessary to fulfill the above purposes, or as long as required by applicable law. Thereafter, the Personal Information collected will be deleted.
"Bavachki.bg has the right to disclose information obtained through the Site and use of the Services or otherwise provided by customers with recipients in order to provide the Service and protect its legal rights. "Recipient" is a natural or legal person, state or local authority to whom personal data is disclosed, whether a third party or not. Bodies that may receive data in the framework of a specific study are not considered recipients.
"Bavachki.bg does not provide your information to Recipients except in the case of:
a) exchange Valid mobile phone numbers, email addresses, postal addresses and additional information regarding the children and the appointment provided by the Parent when applying for a babysitter between Parents and Babysitters, after confirmation of the Commitment. Information may vary depending on the specific request;
b) communication between Users;
c) verification and authentication of Valid mobile phone numbers and emails by a third party provider;
d) appointment of legal advisors/attorneys/legal counsel by Bavachki.bg to represent and defend its legal rights and ordinary course of business and disputes with the person who provided the information, i.e. collection of fees and other liabilities, breach of contract disputes, intellectual property disputes, etc;
e) the appointment of accountants by Bavachki.bg for bookkeeping and accounting services;
f) appointment of collection agencies by "Bavachki.bg" for credit check, identity verification and debt collection;
g) appointment of Babysitters Training Experts;
h) engaging with the Bulgarian Red Cross to provide first aid training to childminders and obtaining certificates;
(i) contact with medical and hospital staff in case of emergency;
(j) Contact with the Ministry of the Interior;
(k) Contact with the State Agency for Child Protection;
(l) cases provided for by law.
By being a Parent or Babysitter, you give your express consent for Bavachki.bg to provide your valid mobile phone number, email and postal addresses and, if applicable, health information of your child/children to other Users of the Services, respectively Parent or Babysitter, for the provision of the Services and further for the best interest of the Users. At times, the provision of a valid mobile phone number, email and/or postal addresses may take place in different territories depending on the location of the Users. You consent to Bavachki.bg transferring your valid mobile phone numbers, emails and/or postal addresses to different territories. Users expressly authorize "Bavachki.bg" to provide their data to other Users in order to provide the Service to all interested parties
You expressly consent to Bavachki.bg providing your Valid Mobile Phone Numbers and email addresses to a third party for verification and identification purposes.
You expressly consent to Bavachki.bg providing your information to recipients as described above.
We do not encourage marketing research or trade of information. We will not sell your Personal Information to third parties nor use it for any marketing purpose to third parties.
TRANSMISSION OF PERSONAL DATA
You consent to the transfer of your Personal Data to a location other than the location of collection for the purpose of providing the Services. The provision is required to comply with the Terms and Conditions between Users and Bavachki.bg.
"Bavachki.bg will not transmit your Personal Data unless one or more of the following conditions are present:
(a) with your explicit consent, i.e. the General Terms and Conditions applicable to Bavachki.bg. Valid mobile phone numbers of Users, valid email and postal addresses and, if applicable, health information of the child/children, are exchanged at the time of finalizing the engagement between Parents and Babysitter;
b) upon your express consent to the acceptance of this Privacy Policy for third party verification and recognition purposes;
c) to recipients in the cases disclosed above;
d) if required by law or court order;
e) only to government entities and with respect to work assigned by you.
Users' valid mobile telephone numbers and valid emails may be subject to a verification and authentication procedure to determine the validity of the telephone numbers and emails provided. The verification and authentication of User's Valid Mobile Phone Numbers and Emails shall be performed by a third party. By accepting this Privacy Policy, all Users agree to have their Valid Mobile Phone Numbers and Emails provided to this third party for processing, for verification and authentication purposes only. Personal data provided to recipients will only be used for the purposes for which it was provided. Users acknowledge and agree that after confirming a childcare commitment their Valid Mobile Phone Numbers, email and/or postal addresses, and, where applicable, health information regarding the child, will be disclosed to other Users (recipients).
"Bavachki.bg may contact the appropriate authorities at its sole discretion if it becomes aware of activities that may be unlawful or in violation of your Privacy Policy.
In the event that some of the recipients are located in the EU, User information may be transferred to the location of those recipients in the EU for the purpose of providing the service.
If you use the Site, your information may be transferred to other locations within the EU in order to provide these services to you.
By submitting your personal information, you consent to the transfer, storage or processing of your data to a different location in the EU in the manner described above.
YOUR RIGHTS IN RELATION TO YOUR PERSONAL DATA
User Declaration
Pursuant to Article 4(1)(2) of the Bulgarian Personal Data Protection Act, and accepting these official rules, i.e. the Privacy Policy and the Terms and Conditions of Bavachki.bg, I hereby agree and declare that: (i) I am aware of the purposes of the processing of my personal data; (ii) I provide my personal data voluntarily; and (iii) I expressly and voluntarily give my informed consent for my personal data to be processed by Babachki. bg" for the purposes set out in this Privacy Policy, including to disclose my Personal Data or my child/children's Personal Data to recipients in accordance with this Privacy Policy.
I consent to my Personal Data and/or my child's Personal Data being processed in accordance with Article 5(2) and (3) and Article 36d(1) of the Privacy Policy. 1(3) of the Bulgarian Personal Data Protection Act as described above.
You have the right to access Personal Data relating to you. In cases where the right of access may result in disclosure to third parties of Personal Data, Bavachki.bg will provide you with access only to that part of the information that relates to you. In exercising your right of access, you have the right to request the following from Bavachki.bg at any time:
(a) confirmation of whether or not data relating to you is being processed, information about the purposes of that processing, the categories of data and the recipients or categories of recipients to which the data are disclosed;
(b) to communicate in an intelligible form the processing of Personal Data and any available source information;
c) information about the logic of any automated processing of your data, at least in the case of automated decisions.
"Bavachki.bg provides access to Personal Data in the manner set out above. You may exercise this right free of charge once every 12 months.
You have the right at any time to request the following from "Bavachki.bg":
1. to remove, correct or block your Personal Data whose processing does not comply with the provisions of the Bulgarian Personal Data Protection Act;
2. to notify any third parties to whom your Personal Data has been disclosed of any removal, rectification or blocking carried out in accordance with paragraph (1), unless this is impossible or involves excessive effort.
The rights mentioned above shall be exercised by written statement addressed to "Bavachki.bg". The statement must be issued by the individual himself/herself or by any person authorized by him/her by notarized power of attorney.
"Bavachki.bg" does not disclose personal data where such data does not exist or the provision of such data is prohibited by law. The user to whom the Personal Data relates has the right to:
1. to object to "Bavachki.bg" to the processing of Personal Data on lawful grounds. Where the objection is justified, the Personal Data of the User concerned may no longer be processed;
2. to object to the processing of his/her Personal Data for direct marketing purposes;
3. be informed before his/her Personal Data is first disclosed to third parties or used on their behalf for the purposes of point 2, and of the possibility to object to such disclosure or use.

"Bavachki.bg will take appropriate technical and organizational measures to protect Personal Data from accidental or unlawful destruction or accidental loss, from unauthorized access, alteration or dissemination, as well as from other unlawful forms of processing. "Bavachki.bg" uses leading-edge technology and encryption software to protect your data, and implements strict security standards to prevent unauthorized access.
